Circumstances (including strikes and lock-outs)
for which MicroFreight Express is not responsible,
but which prevent him in whole or in part from fulfilling
his obligations, will release him from his obligations
in connection with the orders affected by such circumstances,
as long as such circumstances continue. In such
cases MicroFreight Express will be entitled but
not obliged (even if a fixed date for acceptance
of the goods has been agreed) to withdraw from the
contract, even if the order has already been partially
carried out. In such cases the principal is entitled
to the same rights, provided that he cannot be reasonably
expected to execute the contract. Should MicroFreight
Express or the principal withdraw from the contract
in accordance with the provisions set out above,
MicroFreight Express must be recompensed for all
resulting costs.
